Makadara Court Dismisses Five Suspects in Joy Garden Pupil Death

Two principals and three teachers of Joy Garden Primary School who were arrested following the mysterious death of a Grade 8 student in March are now free after the Makadara District Court dismissed them.

The court therefore closed the miscellaneous file and declared that the investigation into the incident has been completed.

The court further recommended a public inquiry rather than prosecution of murder charges, noting that record keeping would be contradictory.

“Since the ODPP issued its opinion, it is up to the police to forward the file to the court and that cannot be the basis for maintaining the various requests,” the court ruled.

The five, through lawyer Danstan Omari, had asked the court to dismiss the case because investigations had acquitted his clients.

“Since the investigation had acquitted the suspects, this would be detrimental to their rights to retain the miscellaneous file, as that would mean that the conditions previously imposed by the court that limit their freedom would remain in place,” Omari argued.

However, the family of the deceased refuted Omari’s plea, arguing that the file should remain active pending the judicial investigation proceedings.

Wesley Njiru fell from the seventh floor of one of the school buildings on March 15, 2024.

Detectives from the Directorate of Criminal Investigations (DCI) visited the school and obtained CCTV footage in an attempt to establish the events leading to the boy’s death.

Two principals, the principal and a teacher of the school were then summoned to the Buru Buru police station to record a statement in this regard.

Njiru’s family subsequently disputed the boy’s autopsy report, citing foul play.

The family insisted that the minor’s death did not coincide with the autopsy report, adding that there was no blood at the crime scene despite the report stating that the student had fallen from the seventh floor.
